A. Any person driving a truck in violation of any of the provisions of this chapter, or the terms or conditions of a special permit issued pursuant to this chapter, shall be liable for a traffic infraction, and upon first conviction thereof shall be fined not less than one hundred fifty dollars ($150) nor more than two hundred dollars ($200), upon a second conviction thereof be fined not less than two hundred dollars ($200) nor more than three hundred dollars ($300), and upon a third or subsequent conviction shall be fined not less than three hundred dollars ($300).

B. Any person, partnership, or corporation owning a truck that is driven in violation of any of the provisions of this chapter, or the terms or conditions of a special permit issued pursuant to this chapter, shall be liable for a civil infraction, and upon first conviction thereof shall be fined not less than one hundred fifty dollars ($150) nor more than two hundred dollars ($200), upon a second conviction thereof be fined not less than two hundred dollars ($200) nor more than three hundred dollars ($300), and upon a third or subsequent conviction shall be fined not less than three hundred dollars ($300). For purposes of determining the number of convictions, the court may include as prior convictions violations of this chapter by any and all operators of trucks owned by the same person, partnership, or corporation, regardless of the identity of the drivers or trucks involved in the violations of this chapter.
