A. A Category 3 WCF Permit for a WCF designated as Tier 4 in the siting preference hierarchy in SMC 14.242.050 shall be reviewed by the Hearing Examiner as a conditional use permit. All other Category 3 WCF Permits shall be reviewed by the City Planner. Approval shall be subject to findings of compliance with the development standards in SMC 14.242.140, the conditions of approval in SMC 14.242.150, and the conditional use approval criteria in SMC 14.55.020, and that the justification under SMC 14.242.050 and SMC 14.242.060, as applicable, contains sufficient engineering analysis to justify the proposal.

B. The City Planner and Hearing Examiner decisions shall be appealable according to the provisions of Chapter 14.20 SMC.
